For a moment last week, it looked as if a bit of sanity might be restored to federal policy on illegal immigration.
The Obama administration announced plans to discontinue a Bush-era rule that sought to force employers to fire workers whose Social Security numbers didn’t match records in federal databases. The reason for the reversal? Those databases are riddled with too many errors.
But the Senate wasn’t about to be seen as so coddling of illegal folks.
By a voice vote it passed an amendment offered by Sen. David Vitter, a Louisiana Republican, that would reinstate the Bush policy. Like the no-match rule, the Vitter amendment requires employers to fire workers who couldn’t resolve such discrepancies within 90 days, even if they were based on bad records.
A a no-match rule sounds simple and reasonable enough. An employer files information through W-2 forms, the government checks such information with its records, and if there’s a mismatch — say, the name doesn’t match the number — the Social Security Administration sends a letter to the employer. If the employee can’t account for the mismatch in 90 days, he’s gone.
But according to Social Security’s Office of the Inspector General, there are close to 18 million discrepancies in the database, and more than 70 percent of them are in the records of native-born U.S. citizens. In other words, the idea that employers could simply plug into a federal database and check to see whether a particular number was valid was flawed from the get-go. But that hasn’t stopped some politicians from continuing to push the idea.
The Obama administration succumbed to those wishes by keeping in place a similar program for federal contractors. It basically has them check Social Security records as well as immigration records — another program built on flawed data. The Social Security Administration’s own estimates suggest that expanding the policy to cover all employers would mean that 11,000 U.S. citizens a day would be misidentified as being ineligible for work.
Somehow, I don’t think members of Congress would appreciate the flood of calls those voters would place.
As it happens, in 2007 a federal court blocked the no-match program in response to lawsuits charging that it would put workers with legal status at risk of losing their jobs and encourage discrimination on the part of employers. Some employers, it was discovered, were turning away anyone who appeared “foreign” simply as a way to avoid a messy no-match problem with a potential employee.
There have been other unintended consequences to the crackdown on fake Social Security numbers. It compelled many illegal immigrants to look for ways to use a name and number that matched — in other words, to engage in identity theft.
Identity theft is no joke. And, obviously, the government cannot turn a blind eye to illegal immigrants, who are estimated to number as many as 12 million. But as Congress readies itself for the brawl that will surround immigration reform, their efforts would be best focused on attacking illegal immigration from the other direction — the pipeline — rather than working backwards to rid the nation of people already illegally living here. Our federal agencies’ record-keeping also clearly has to be cleaned up.
But it’s probable that flawed records will never be entirely purged, and so U.S. citizens will continue to be ensnared in bureaucratic difficulties whenever they change jobs.
In their haste to “do something” about illegal immigration, senators have shown how unserious they are about actually addressing the problems at the heart of our immigration policy. Sounding tough on illegal immigrants may feel good in D.C., but when citizens back home become embroiled in the mess, you can bet a backlash will come.

Just because these errors may cause a few problems for others with hispanic surnames, she would rather have a do nothing policy. Yeah Mary, sitting on our hands and doing nothing is the real solution to the huge problem of illegal immigration.
Errors or not the SSA database is the best tool we have to address the problem.

I can't say the ILLEGAL ALIENS are completely to blame for the shape of our economy, but they are a BIG part of the problem. The ILLEGAL ALIENS send BILLIONS upon BILLIONS out of this Country every year, money we will NEVER see again. Does this help our economy?
How about the BILLIONS the American taxpayers fork out for the ILLEGAL ALIEN BABIES, the schooling of them, the medical care and the list goes on, and on, and on.
How about the MILLIONS upon MILLIONS paid to jail ILLEGAL ALIENS for the crimes, then the cost to deport them. Does this help our economy?
Then you have these activist groups, the Catholic Church and the ACLU that want AMNESTY for these ILLEGAL ALIENS. It would be absolute suicide for this Country if AMNESTY were granted to the 20 million or so ILLEGAL ALIENS. We have more and more people out of work everyday and they want to add another 20 million to this Country? I say, "NO"!
If AMNESTY were ever granted to these 20 million ILLEGAL ALIENS, you can bet big money that 3 years from now, there would be ANOTHER 3-5 million ILLEGAL ALIENS demonstrating on our soil for AMNESTY.
An end MUST come to this illegal immigration. The perfect tool we have so far is E-Verify. It MUST be used by ALL businesses and Government Social Services. EVERY employee must be checked! If they are illegal, they are to be dismissed!
I believe it is time for all 50 States to pass a State law, like Arizona, Oklahoma, Mississippi, Missouri, South Carolina and a few others. It is time for these ILLEGAL ALIENS to go back to their home Country and get out of this Country. The problems they are causing will not go away until the ILLEGAL ALIENS are out of this Country. I think that is plain to see.
It's time for ZERO TOLERENCE with these ILLEGAL ALIENS. It's time for them to get back to their own country where they belong.

The title says it all. Since Reagan, every President and Congress have failed to enforce immigration laws and secure our borders. E-Verify needs to be mandated for every employer. The border needs to be secured even 8 years after 9/11. Every illegal alien needs to be deported, every criminal employer needs to be jailed and every elected official needs to be replaced by statesmen that will enforce our laws. The 1986 amnesty was a total failure! Never again!

I thought that the majority of errors in the SS database involved simple things. Such as, last name changed due to marriage, address incorrect due to relocation, and other things that involve the individual not updating the SS information. You indicated that the Bush plan was blocked in 2007, but it is being used today. What happened to the case? Seems like your piece lacks so many pieces as to make it worthless, other than change means stay the same.
